Who we are

| Art Concierge is an online fine art brokerage founded and operated by Jennifer Victor. You can reach us at jennifer@ourartconcierge.com or 786-518-1462, Monday to Friday, 9:00 to 5:00.

These terms cover your use of this website and any purchase, consignment or appraisal we agree with you. Where we sign a separate written agreement with you, that agreement takes precedence over anything on this page.

What we do, and what we do not do

We act as a broker. In most transactions we introduce a buyer to a work held by an owner, a gallery, an estate or another dealer, and we are not the seller of record. Where we do sell a work we own outright, we will say so in writing before you pay anything.

We are not an auction house and we do not operate a public gallery. Nothing on this site is investment advice. Art is not a regulated financial product, past prices do not predict future prices, and no work should be bought on the expectation that it will appreciate.

Listings, availability and prices

Every work shown on this site is offered subject to prior sale and subject to our confirmation. Availability changes without notice, and a work marked as available may have sold since the page was last updated.

Images are reproduced as faithfully as we can manage, but colour, texture and scale vary between screens. Dimensions, media, edition details and dates are given in good faith from the information supplied to us by the owner or by the artist. Where a price appears, it excludes shipping, insurance, framing, and any sales, use or import tax, and it is valid only for the period we state in writing.

An enquiry submitted through this site is not an offer to sell and does not reserve a work. A sale is agreed only when we confirm it to you in writing and your payment has cleared.

Paying, and when a work becomes yours

We invoice in US dollars. Unless we agree otherwise in writing, payment is due in full before a work is released, and we accept bank transfer and the other methods named on the invoice. Title to a work passes to you when we receive cleared funds in full — not when an invoice is issued and not when a payment is initiated.

You are responsible for any sales, use, import or export tax, customs duty and any licence required to move a work across a border. We will tell you what we know about a work's export status before you commit, but we cannot guarantee that a licence will be granted.

Authenticity, condition and provenance

We describe every work as accurately as we can from the documentation available to us, and we pass on any certificate of authenticity, catalogue raisonné reference, condition report or provenance record that comes with it. Where a work is described as being after an artist, or as an estate-authorised edition, that is stated plainly on its page.

Descriptions are statements of opinion, not guarantees, except where we give you a written warranty of authenticity. We encourage you to inspect a work in person, or to commission your own condition report or authentication, before you buy. Tell us within seven days of delivery if a work differs materially from its description.

Consigning a work to us

If you consign a work for us to sell, we will agree in writing the reserve, our commission, the consignment period, who insures the work and where it is stored. You confirm that you own the work free of any lien or claim, that you are entitled to sell it, and that the information you give us about it is accurate.

We do not take title to consigned work. We will account to you for the sale proceeds, less our agreed commission and any costs you have approved, within the period set out in the consignment agreement.

Shipping, packing and risk

We arrange shipping through specialist fine art shippers wherever the work justifies it. Costs for packing, crating, transit insurance and delivery are quoted separately and are payable by the buyer unless we agree otherwise.

Risk passes to you on delivery to you or to a carrier you nominate. Inspect the packaging and the work on arrival. Report any transit damage to us and to the carrier within three business days, keep all packing materials, and photograph the damage before anything is moved — a claim is very difficult to make without those three things.

Returns and cancellations

Original art and editioned works are sold as unique items. Once a sale is confirmed and paid, it is final, except where a work turns out to differ materially from its written description or where we have given you a written warranty that has been breached.

If either applies, tell us within seven days of delivery, keep the work in the condition it arrived in, and we will arrange its return at our cost and refund what you paid for it. We do not refund shipping, framing or installation costs on a return that is not our fault.

Appraisals

Appraisal reports are prepared by Jennifer Victor, a candidate of the American Society of Appraisers, in accordance with the Uniform Standards of Professional Appraisal Practice (USPAP). Each report states its own effective date, intended use and intended users.

An appraisal is an opinion of value for a stated purpose on a stated date. It is not an offer to buy, not a guarantee that a work will sell at that figure, and not authentication. It may not be relied on for a purpose other than the one it names, and it may not be relied on by anyone other than the intended users it names.

Our fee is agreed in advance and is never contingent on the value we report, on a transaction completing, or on any predetermined result. Where we have a financial interest in a work, or have brokered it, we disclose that in the report.

Using this website

Please use this site lawfully and do not attempt to scrape it, disrupt it or interfere with anyone else's use of it. We may change or remove anything on it at any time.

We do our best to keep the site accurate and available, but we provide it as it is. To the extent the law allows, we are not liable for indirect or consequential loss arising from your use of the site, and our total liability in connection with a transaction is limited to the amount you paid us for the work concerned.

Accessibility

We want this site to be usable by everyone, and we build it to meet the Web Content Accessibility Guidelines (WCAG) 2.1 at level AA. That means readable type at every screen size, real alternative text on artwork images, visible keyboard focus, colour contrast that passes at body size, and motion that respects a reduced-motion setting.

Privacy Policy

What we collect

When you send an enquiry we collect the name, email address, phone number and message you give us, and the work you were looking at if you started from an artwork page. When you buy or consign, we collect what we need to complete and record that transaction, including billing and delivery details.

This site sets no advertising cookies and runs no third-party tracking or analytics. We do not build a profile of you and we do not use your details to target advertising.

Why we use it, and how long we keep it

  • To answer your enquiry and to talk to you about a work.
  • To complete, deliver and record a sale, a consignment or an appraisal.
  • To meet our legal, tax and anti-money-laundering obligations.
  • To send you occasional news about available work — only if you have asked us to, and every message carries a one-click unsubscribe.

We keep enquiry correspondence for as long as it is useful to the conversation and then delete it. Transaction and appraisal records are kept for as long as tax and professional record-keeping rules require.

Who sees it

Your details are handled by Jennifer Victor. We share them only with the people needed to do what you asked — a shipper, an insurer, a payment provider, our accountant, or the owner of a work you are enquiring about — and only as far as that task requires. ⛔ We do not sell your personal information, and we do not share it for cross-context behavioural advertising.

Your choices

Write to jennifer@ourartconcierge.com to ask what we hold about you, to correct it, to have it deleted, or to stop hearing from us. We will respond within thirty days.

Children

This site is not directed at children, and we do not knowingly collect information from anyone under sixteen.

California residents

If you live in California, the California Consumer Privacy Act as amended by the CPRA gives you the right to know what personal information we have collected about you and why, to have it corrected or deleted, to limit the use of sensitive personal information, and not to be treated differently for exercising any of those rights.

We do not sell personal information and we do not share it for cross-context behavioural advertising, so there is nothing for you to opt out of — but you are entitled to ask, and we will confirm that in writing. Make a request by emailing jennifer@ourartconcierge.com with "California privacy request" in the subject line. An authorised agent may make a request for you with your written permission.

Changes, and the law that applies

We may update this page. The date below is the version in force, and the terms that apply to a transaction are the ones published when we confirmed it.

These terms are governed by the laws of the State of New Jersey, and any dispute will be heard by the courts of that state. If any part of this page is found unenforceable, the rest of it still stands.
